These General Terms and Conditions govern the purchase of products through the website mercado46.com, owned by Mercado 46 Distribución Selecta S.L. Mercado 46 makes every effort to ensure that product descriptions, images, and prices are accurate. However, errors may occasionally occur. In the event of a pricing error, we will notify you before processing the order. Product availability is subject to stock levels. If an ordered product is unavailable, we will inform you and offer an alternative or full refund.

4. Prices & Payment

All prices include VAT (IVA) applicable in Spain unless otherwise stated. Prices do not include shipping costs, which are calculated at checkout. Payment is processed securely through Stripe. We accept Visa, Mastercard, American Express, and Bizum. Payment is charged at the time of order confirmation.

5. Order Process & Confirmation

By placing an order, you make an offer to purchase the products. The contract is formed when we send you an order confirmation email. Mercado 46 reserves the right to refuse or cancel orders at its discretion, particularly in cases of suspected fraud or errors in product information.

6. Right of Withdrawal

In accordance with EU consumer law (Directive 2011/83/EU), you have the right to withdraw from the purchase within 14 calendar days of receiving your order, without giving any reason. To exercise this right, notify us at info@mercado46.com using the model withdrawal form in Annex I below. Products must be returned in their original condition and unopened. Return shipping costs are borne by the customer unless the product is defective.

7. Refund Period

Once we receive and inspect the returned products, we will issue the refund within 14 calendar days of your withdrawal notification, using the same payment method as the original purchase. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent them back.

8. Legal Guarantee

Products sold through mercado46.com are covered by the 2-year legal conformity guarantee provided for in Royal Legislative Decree 1/2007 (General Consumer Law). If you receive a defective or non-conforming product, please contact us at info@mercado46.com.

9. Online Dispute Resolution

In accordance with EU Regulation 524/2013, consumers may access the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/

10. Applicable Law & Jurisdiction

These Terms are governed by Spanish law. Any disputes arising from these Terms or from purchases made through mercado46.com shall be subject to the jurisdiction of the courts of Málaga, unless consumer protection legislation provides otherwise.
